Parking environmental enforcement relates to environmental offences such as littering and fly-tipping. Fixed Penalty Notices (FPNs) can be issued for environmental offences committed at parking locations.
What are Littering offences?
A littering offence is committed if waste is discarded and left by an individual. While this is a low-level offence, it still falls under the legislation of the Environmental Protection Act 1990.
Parking enforcement can include environmental offences such as littering. Authorised enforcement officers can issue contravention notices for these offences.
What are Fly-tipping offences?

Fly-tipping is an environmental offence and the offence is committed if waste materials are improperly discarded. The Environmental Protection Act 1990 requires anyone who produces waste to ensure it is disposed of properly. If a vehicle is used for fly-tipping the registered keeper is liable for conviction of this offence.
Another act of legislation covering environmental offences management is the Care Act 2014. This requires the safe management of waste to protect human health and the environment. The duty of care defined in this legislation applies to anyone who is a ‘waste holder’. This is anyone who imports, produces, carries, keeps, treats, disposes of, or acts as a dealer or broker that has responsibility for controlled waste.
A separate duty of care applies to domestic householders which requires them to ensure their waste is transferred to an authorised person such as refuse operatives.
If a large volume of waste or hazardous waste is dumped in a parking location the Environment Agency may investigate the incident which may lead to enforcement action.
What are the penalties for fly-tipping?
Fixed Penalty Notices (FPNs) can be issued for fly-tipping. Anyone in the UK who is prosecuted and convicted for fly-tipping can face an unlimited fine or be imprisoned for up to 5 years.
Anyone who is a waste management operator, a repeat offender, or someone who has fly-tipped hazardous waste will be prosecuted by the Local Authority. Local Authorities gather environmental incident information to be able to prosecute offenders. They will collect the offence circumstance information and build a legal pack which is then handed to the prosecutors.
